Welcome to the services offered by FASTPOTATO PTE. LTD. ("we," "us," "POTATO," or "our"). These Terms of Service (the "Terms") govern your access to and use of services provided across our AI products, including ChatMax and VideoMax (the "Services"), as well as our websites, software, and applications.

By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. Scope and Cross-Platform Account

Integration

1.1 Services Overview

FASTPOTATO provides two distinct AI products integrated under one ecosystem:

  • ChatMax: A conversational platform powered by multiple AI model APIs.
  • VideoMax: A platform for generating videos via AI-powered tools and APIs.

1.2 Account Integration

Your registered account on either ChatMax or VideoMax can be used to access and benefit from both platforms ("Account Integration"). This integration enables users to enjoy account-related benefits across both products seamlessly. By agreeing to these Terms, you consent to such interoperability while remaining subject to platform-specific guidelines, feature limitations, and restrictions where applicable.

1.3 Legacy Subscription Plans

Certain legacy subscription plans initiated before the introduction of Account Integration may retain their original benefits and configurations. As a result, users under these legacy plans may not automatically have access to the full range of new cross-platform features or benefits introduced with Account Integration.

1.4 Account Accuracy and Compliance

Please ensure that all account information you provide is accurate and current. Violation of these Terms or misuse of Account Integration may result in account suspension or termination.

2. Consent and Age Requirements

By accessing, installing, or using the Services, you:

  • Confirm that you have read and agree to be bound by these Terms and our Privacy Policy.
  • Acknowledge that these Terms may be updated periodically. Continued use of the Services after any updates constitutes your acceptance of the modified Terms.

2.1 Age Eligibility

The Services are intended solely for users who are at least 18 years old (or the minimum required age in their jurisdiction, whichever is higher). This applies to all Potato AI products, including ChatMax and VideoMax. By using the Services, you represent and warrant that you meet these eligibility requirements.

3. Coins Usage

FASTPOTATO provides Coins ("Coins") as a flexible means for users to access features and services across both ChatMax and VideoMax. Details of the usage of Coins are outlined as follows:

3.1 Types and Validity of Coins

Different types of Coins may have varying terms of use and expiration periods depending on their intended functions or promotional campaigns. Key considerations include:

  • Certain types of Coins may be restricted to specific features or services and cannot be used universally across all functions.
  • Purchased Coins generally have a longer validity period, while promotional or gifted Coins may have shorter expiration terms.
  • Coins that exceed their valid usage period will automatically expire. Expired Coins are non-refundable and cannot be transferred or reinstated.

3.2 Rules for Policy Adjustments

We reserve the right to modify rules regarding the use, duration, and functionality of Coins at any time. FASTPOTATO may, at its discretion, update Coins policies or reallocate their applicability. While we will make efforts to notify users of significant changes through announcements, we recommend users periodically review these Terms for updates.

3.3 Right of Interpretation

FASTPOTATO retains the final authority to interpret the conditions and policies concerning the use and migration of Coins. In the event of ambiguities or conflicts, you agree to adhere to our final determination.

4. Subscription Plans and Refund Policy

4.1 Subscription and Payments

  • Both ChatMax and VideoMax offer subscription-based services. Details of available plans and pricing are provided on their respective websites.
  • Subscriptions are prepaid for the selected duration. Payment processing is conducted via third-party payment providers.

4.2 Auto-Renewal and Cancellation

  • All subscriptions renew automatically by default for the same duration as the original billing term. Users may disable auto-renewal via account settings before the new subscription cycle begins.
  • Auto-renewal is enabled when using supported payment methods (e.g., Credit Card, PayPal) and disabled for non-supported payment methods (e.g., CoinPayments).

4.3 Refund Policy

  • Refunds for subscriptions are managed by third-party payment processors. Violations of these Terms or engagement in illegal activities will void any refund eligibility.
  • Purchases made via CoinPayments are non-refundable under any circumstances.

5. User Guidelines

Our platforms, ChatMax (AI chatbot product) and VideoMax (AI video-generation product), are committed to providing advanced AI-powered services while maintaining a safe, legal, and ethical usage environment. Although we do not collect personally identifiable information from our users, compliance with governing laws and platform policies is mandatory.

5.1 Intellectual Property Notice

Users of ChatMax and VideoMax must adhere to the following principles to ensure intellectual property compliance:
  • Legitimacy of Submitted Content: All content submitted to the platform—such as text, images, code, and other media—must be legally sourced. Users must own the content or have the necessary permissions to use it. Unauthorized uploads of third-party copyrighted material are strictly prohibited.
  • Ownership of User Content: The intellectual property rights of user-submitted content, including any AI-generated outputs, belong to the users themselves. Users bear full responsibility for ensuring they own or have the appropriate rights to their inputs and outputs.
  • Platform Usage License: By using our platforms, users grant us the right to store and utilize submitted content and AI-generated outputs to improve or optimize services. This usage will always comply with laws and not infringe upon users' rights.

5.2 Prohibited Content and Conduct

Users of ChatMax and VideoMax are prohibited from uploading, generating, or sharing content that falls into the following categories:

  • Infringing Content: Material that violates third-party intellectual property rights, such as unlicensed copyrighted works.
  • Harmful or Offensive Material:
    • Insulting or defamatory content aimed at harming others.
    • Discriminatory content targeting race, gender, religion, disability, age, or other protected attributes.
    • Inappropriate or obscene content, including vulgar, pornographic, violent, or terror-related material.
  • Political and Illegal Content:
    • Content containing sensitive politics or defamation toward governments, countries, or political entities.
    • Any content that is illegal under local or international laws.
As a user, you are entirely responsible for any content you submit, generate, or share through our platforms.

5.3 Risk Warnings

While ChatMax and VideoMax aim to provide reliable AI-generated content, users must exercise caution in sensitive or high-impact areas:

  • Finance, Legal, and Professional Advice (ChatMax): AI-generated outputs are not substitutes for professional advice. Consult experts for financial, investment, legal, or business decisions.
  • Health and Medical (Both Platforms): AI-generated responses or videos cannot replace professional medical consultations, diagnoses, or treatments. Always seek advice from certified healthcare providers.
  • Children and Minors: Content involving minors—whether text-based (ChatMax) or visual (VideoMax)—must be crafted with extreme care. Misleading or harmful material targeted at children is strictly prohibited.
  • Authenticity of AI-Generated Content (VideoMax): Clearly label AI-generated or modified videos to avoid misleading others about their authenticity.
  • Other Sensitive Topics: AI-generated outputs on sensitive subjects should be approached with caution. Verify information independently before taking action.

5.4 User Responsibility and Reporting

Users are responsible for assessing the reliability and accuracy of AI-generated outputs. The platforms bear no liability for consequences arising from reliance on generated content. If you encounter prohibited content or behavior, report it immediately to [email protected].

5.5 Termination and Account Security

Failure to comply with these guidelines or any applicable laws may result in the restriction or termination of your access to our services. Specifically:

  • Account Usage: Accounts on both platforms are intended for personal use only. Leasing, sharing, or lending accounts is strictly prohibited to ensure security and prevent misuse.
  • Security Measures: Protect your account credentials to prevent unauthorized access. If we detect any violations, such as password sharing or account misuse, we reserve the right to limit the number of login devices, terminate accounts, and delete related data, with no entitlement to refunds.

5.6 Content Moderation

You acknowledge and agree that POTATO reserves the right, but is not obligated, to review, monitor, screen, edit, or remove any user-generated content at any time and for any reason, including but not limited to usernames, profile avatars, posts, comments, images, videos, and any other material submitted or published within the community. We may use a combination of automated tools and manual reviews to maintain a safe, lawful, and positive environment.

Content moderation and enforcement actions are guided by these Terms, as well as our Community Guidelines. All users are required to familiarize themselves with and adhere to the Community Guidelines when using any community features.

POTATO also reserves the right to suspend or terminate access to the Services in cases of repeated or serious violations of our Terms, Community Guidelines, or applicable laws. The platform may retain, remove, or report content as required by law or to comply with requests from law enforcement or regulatory authorities.

By using the community features, you understand and agree that your submitted content may be subject to moderation before or after publication, and you agree to cooperate with any inquiries or actions necessary to uphold the integrity of the community.

6. Reporting Inappropriate Ads

If you encounter advertisements you believe to be inappropriate, illegal, or in violation of regulations, you can report them using the following procedures:

  • Provide necessary details, including when and where you saw the ad. If possible, include supporting materials such as photos, videos, or screenshots.

Please note that if insufficient detail is provided, we may not be able to adequately assess or address your report.

7. Account Security and Termination

7.1 Security Obligations

Users are responsible for safeguarding their account credentials. Sharing, leasing, or lending accounts is strictly prohibited. FASTPOTATO may impose restrictions or terminate accounts found to be compromised, shared, or misused.

7.2 Violation of Terms

Should you breach these Terms or any applicable laws, we reserve the right to take action, which may include:

  • Suspending or terminating your account without notice.
  • Removing any prohibited content.
  • Denying refunds for subscriptions related to the violation.

8. Third-Party Services and Data Privacy

The Services integrate APIs from third-party AI providers. By using these third-party services, you agree to comply with their respective Terms of Service:

9. Disclaimer and Indemnity

9.1 Disclaimer

The Services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind. We do not guarantee uninterrupted or error-free operation of the Services. Users assume full responsibility for the risks associated with using the Services.

9.2 Indemnity

You agree to indemnify and hold harmless FASTPOTATO, its affiliates, officers, and employees from liabilities, claims, and expenses (including legal fees) arising from your violation of these Terms or any applicable laws.

10. Governing Law and Dispute Resolution

These Terms and any disputes arising from them are governed by the laws of Singapore. Parties agree to submit any disputes to the exclusive jurisdiction of the courts of Singapore.
